1. Introduction
Welcome to CleanCal (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the CleanCal platform, website, and related services (the “Service”). By creating an account or using CleanCal, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts. By using the Service, you represent and warrant that you have the authority to bind yourself or the entity you represent and that all information you provide is accurate and current.
3. Nature of the Service
CleanCal is a software coordination platform that enables property managers and cleaners to organize cleaning schedules, communicate, and manage operational workflows.
CleanCal:
- Is not an employer of cleaners
- Is not a staffing or employment agency
- Does not supervise or control cleaning services
- Does not guarantee the quality, legality, or safety of services performed
All service relationships are strictly between users. Users are solely responsible for complying with labor, tax, and regulatory obligations.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or unlawful conduct.
5. Subscriptions and Payments
Certain features of the Service may require a paid subscription.
- Fees are billed in advance.
- Payments are non-refundable unless required by law.
- We may modify pricing with prior notice.
- Failure to pay may result in suspension or termination of access.
Payments are processed through third-party providers. CleanCal is not responsible for errors or failures caused by payment processors.
6. User Responsibilities
You agree not to:
- Use the Service for unlawful purposes
- Provide false or misleading information
- Upload malicious code or attempt to disrupt the platform
- Reverse engineer or copy the software
- Scrape or extract data without authorization
You are solely responsible for your interactions with other users.
7. Third-Party Integrations
The Service may integrate with third-party platforms (such as messaging tools or booking platforms). CleanCal does not control and is not responsible for third-party services, policies, or downtime. Use of third-party services is subject to their respective terms.
8. Intellectual Property
All software, branding, content, and materials related to CleanCal are owned by the Company or its licensors and are protected by intellectual property laws.
You retain ownership of data you upload but grant CleanCal a limited license to use such data solely for the purpose of providing and improving the Service.
9. Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted, error-free, or secure access. We may suspend or modify the Service at any time for maintenance, updates, or operational reasons.
10. Limitation of Liability
To the maximum extent permitted by law, CleanCal shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or business opportunities
- Disputes between users
- Acts or omissions of property managers or cleaners
Our total liability shall not exceed the amount paid by you to CleanCal in the three (3) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold CleanCal harmless from any claims, damages, losses, liabilities, and expenses arising out of your misuse of the Service, violation of law, or disputes with other users.
12. Termination
We may suspend or terminate your access to the Service at our discretion if you violate these Terms. You may cancel your subscription at any time. Upon termination, access to your account may be revoked and data may be deleted after a reasonable period.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute shall be resolved through binding arbitration unless otherwise required by applicable law.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
